1 Provider and covered resources
1.1 The provider is Olive Robotics GmbH, Daimlerstraße 7, 85521 Ottobrunn, Germany, registered at Amtsgericht München, HRB 281200, VAT identification number DE358511336, represented by Managing Director Dr.-Ing. Mojtaba Karimi. Contact: contact@olive-robotics.com; general enquiries: info@olive-robotics.com; telephone +49 155 6335 0077.
1.2 These terms cover the Olive-operated pages at https://www.olive-robotics.com, the company documentation at https://docs.olive-robotics.com, and any Olive portal, demonstration tool, data laboratory, download or API that expressly refers to them. They do not apply merely because a third-party website mentions Olive or includes its trademark.
1.3 The covered resources may include product information; IMU Data Lab, ROS Media Lab and Time-Series Lab tools; instructions, CAD and STEP models, drawings and example configurations; software downloads; support interfaces; event registration; and account or developer functionality actually provided. A list of possible functionality does not promise that every service is currently available.
1.4 Olive's official external profiles supplied for this version are https://www.linkedin.com/company/olive-robotics, https://www.youtube.com/@olive-robotics and https://github.com/olive-robotics. Those platforms operate under their own rules and privacy notices. Olive's rights in its own content and applicable legal responsibilities are unaffected.
2 Agreement and relationship to other documents
2.1 Where an account, download or tool requires acceptance, the terms must be available before the acceptance action and capable of being retained. The accepted version and any service description govern. A reference in a footer alone does not retroactively amend a purchase, grant a software license or create a confidentiality agreement over already public information.
2.2 Product sales and professional services are governed by the separately incorporated Terms and Conditions. Software execution, copying and distribution are governed by the applicable software license. Open-source licenses govern their components. A service-specific agreement takes priority on its subject matter, subject to individual agreements and mandatory law.
2.3 The Privacy Policy describes processing and rights. It is not an agreement to tracking, marketing or unrestricted data use. Any required consent must be requested separately, be specific and voluntary, and be withdrawable without changing the lawfulness of prior processing.
2.4 The public website is available to visitors generally. Business accounts and professional tools are intended for persons acting for a business, research institution or other professional organisation with appropriate authority and competence. A person cannot waive consumer status simply by selecting a business option. Minors must not enter contracts or use hazardous tools without the legally required authority and supervision; public reading is not conditioned on a blanket assertion that every visitor is 18.
3 Development purpose and prohibition of dangerous use
3.1 Olive's standard sensors, robotics platforms, actuators, embedded modules and associated evaluation software are supplied for professional research, development, evaluation and prototype integration unless a specific contract expressly provides a different lawful purpose. Online instructions, CAD files, simulations, demonstrations, downloads and examples must be used within the relevant product and license scope. Access to a page is not production approval.
3.2 Do not use an Olive development resource to create or operate an application exposing a person, animal, property, the environment or essential services to an uncontrolled hazard. In particular, do not allow a foreseeable error, missing output, interrupted connection or unintended command from an experimental system to create an unmitigated danger outside a controlled test arrangement. If suitable protection cannot be established, do not conduct the activity.
3.3 A development sensor, AI estimate, demonstration program, ordinary communications link or browser interface must not be relied upon as the required protective function against a hazardous event. A stop control, redundant measurements or a confidence value does not itself establish a safety-rated system. No safety integrity level, performance level or system certification is granted by these Terms of Use.
3.4 Under the development scope, live life-support or medical use, passenger carriage, active vehicle or aircraft control, hazardous process control, nuclear safety, explosive-atmosphere operation and protection of critical infrastructure are prohibited. Contained non-operational laboratory research is permitted only within the documented scope and with no such live function or uncontrolled hazard. Routine production operation and unprotected public deployment require a separately agreed and legally assessed scope.
3.5 Before any example affects physical equipment, the user must validate the applicable hardware and software version, units, coordinate frames, limits and interface assumptions. Establish competent supervision, a controlled test area, independent safeguards, a safe stopping method and a recovery procedure proportionate to the actual hazards. Do not flash firmware, alter networking, disable a protection or execute an unfamiliar motion command on an operational system without those controls.
3.6 The customer acting as manufacturer, integrator or operator must perform the assessment, validation, documentation, conformity work, instructions and approvals attaching to that role before deployment. Examples on Olive's website do not complete those tasks. Applicable workplace duties, including § 3 BetrSichV in Germany, remain with the responsible employer or operator; a component's CE marking is not a substitute for assessing its use.
3.7 Stop the affected use promptly and secure the system if an unexpected output, motion, overheating, damaged safeguard or other credible condition creates a safety concern. Notify Olive of a relevant product issue through contact@olive-robotics.com and retain proportionate evidence. A web form, support ticket or uploaded log is not a monitored emergency service, and the user must not postpone necessary local protective action pending a response.
3.8 The R&D designation does not create a general exemption from product law. Actual product-specific declarations and the criteria of the applicable regime govern. Olive retains its own mandatory duties for its products and services. Sections 3.1 to 3.7 define permitted activity and user precautions; responsibility for loss remains subject to section 14 and applicable law.
3.9 A product support discussion, code example, forum answer or employee's attendance at a test does not by itself enlarge the agreed purpose or certify the user's system. Any separate engineering engagement, binding statement or expressly assumed obligation retains its actual legal effect. Safety and vulnerability notices apply to the affected version and take precedence over an obsolete example for safe operation.
4 Permitted access and use of materials
4.1 Subject to any more specific license, Olive permits lawful viewing of its public pages and downloading or printing reasonable copies for evaluating, integrating and operating its products within the permitted purpose. Keep attribution, version information and relevant warnings with a copy. No fee or account is required solely by this clause to read a public page.
4.2 Product documentation may be reproduced internally and supplied to persons who need it to lawfully evaluate or operate the relevant product. An integrator may incorporate necessary safety and operational extracts into its final-system instructions with clear attribution, version control and no misleading alteration. A wholesale republication, commercial documentation service or redistribution beyond those purposes requires permission or an independently applicable right.
4.3 CAD, STEP, mechanical drawings, dimensions and interface models supplied for integration may be used to design fixtures, enclosures, mounts and compatible application interfaces. They do not grant a license to reproduce Olive's product, manufacture its proprietary circuit boards, copy protected industrial designs or remove third-party rights. A separately stated open-hardware or permissive license takes precedence for the relevant asset.
4.4 Code samples and SDK files carry the license stated in the file, repository or download package. A file without an identified redistribution license must not be assumed to be open source. Request clarification if the notices are missing. These terms do not narrow rights granted by an applicable MIT, BSD, Apache, GPL, LGPL or other license.
4.5 Olive and its licensors retain intellectual property rights in their respective materials, software, documentation, graphics, brands, datasets and confidential know-how. Product names may be used for truthful identification and compatibility statements allowed by law. Permission to use a product does not authorise implying endorsement, registering confusing domains, using Olive branding as the user's own mark or publishing an altered logo as official artwork.
5 Prohibited conduct
5.1 Users must not unlawfully access another person's account or data; bypass authentication or access restrictions; introduce malware; interfere with service operation; submit unlawful or infringing content; impersonate Olive or another person; conduct payment fraud; or use the resources for prohibited exports or unlawful surveillance. Restrictions apply to conduct, not to a user's lawful criticism or exercise of rights.
5.2 Automated access must respect communicated technical limits and must not cause unreasonable load, defeat access controls or extract protected content without a lawful basis. General search-engine indexing of public pages is permitted within the site's published controls. A robots.txt entry is not, by itself, a complete statement of copyright permissions or security authorisation.
5.3 Olive reserves rights in its copyright-protected online content against text and data mining for purposes, including model training, for which a reservation is legally effective. Online reservations must also be expressed in an appropriate machine-readable form where § 44b(3) UrhG requires it. This clause does not restrict mandatory scientific research exceptions, other non-waivable rights or licenses that independently authorise the use.
5.4 Users must not publish credentials, private keys, exploit details that unlawfully endanger others, personal data without authority or third-party confidential information in public support channels. Contact Olive privately for sensitive disclosures. This rule does not prohibit protected reporting to authorities, lawful whistleblowing or responsible vulnerability research.
5.5 There is no blanket ban on comparative testing, truthful benchmarks, interoperability work or independent research. Users must respect applicable licenses, confidentiality, third-party rights and safety. Public claims must not knowingly misrepresent the product, the test conditions or the relationship with Olive.
6 Accounts and organisation administrators
6.1 Account information must be accurate and current. Use individual credentials and any available required multifactor authentication. An organisation should appoint authorised administrators and promptly revoke access for persons no longer authorised. Account recovery requires proportionate evidence that protects against takeover.
6.2 Users must notify Olive without undue delay of suspected compromise and cooperate in reasonable containment. Responsibility for unauthorised actions depends on fault, contractual responsibility and applicable law; the account holder is not automatically liable for every action performed using stolen credentials.
6.3 An organisation administrator may have access to the organisation's account records and configuration within the permissions described by the relevant service. Do not use a business account for private confidential material without understanding those controls. This notice does not authorise undisclosed employee monitoring.
6.4 Sharing accounts beyond the agreed license metric, reselling credentials and misleading sign-up information are prohibited. Olive may request a correction or proportionate verification before restricting an account. A request for unnecessary identity documents or personal information is not justified merely by this provision.
7 Uploads and customer materials
7.1 The user retains its rights in uploaded datasets, logs, media, drawings, code and other materials. It grants Olive only the rights necessary to provide the requested processing, display, support or hosting, including authorised technical subcontracting, and to comply with law. The license lasts as long as necessary for those purposes and applicable retention. It does not authorise unrelated public distribution, sale or general-purpose model training.
7.2 The user must have the necessary rights and lawful basis for its submission. Robot logs, ROS bags, images, thermal recordings, maps, precise locations and device identifiers can reveal individuals, confidential layouts and customer operations. Remove unnecessary information, secrets and credentials before upload. Olive's independent data protection and security obligations remain unaffected.
7.3 A private upload is not public merely because it is processed through a browser. Whether a tool processes locally, transmits to Olive or uses another service must be described at the point of use. Do not assume that every browser tool is offline, that all telemetry is disabled or that every transfer uses a particular country. The actual service notice and configuration control.
7.4 Public forum posts, issue reports or contributions are visible to the stated audience and may remain in lawful repository histories or quotations. A public contribution license or contributor agreement must be clearly identified before submission. Submitting an ordinary bug report is not an assignment of all inventions or intellectual property.
7.5 Voluntary feedback that does not include confidential information may be used to improve products without an obligation to implement it or compensate the sender, to the extent the sender lawfully authorises that use. This does not transfer patent rights, waive copyright moral rights or grant rights in data belonging to someone else. Patentable proposals should be addressed under a separate agreement.
8 Demonstration tools and generated outputs
8.1 Calculators, visualisers, simulated streams, processing examples and AI-assisted outputs support evaluation. Their input requirements, units, assumptions and limitations must be considered. Unless a paid service expressly promises a result, they are not a calibration certificate, accredited test report, compliance determination or safety validation.
8.2 Independently validate output before relying on it for a design, purchase, physical action or regulated decision. A simulation may omit failure modes, sensor bias, timing jitter, thermal drift, electromagnetic effects, wheel slip and interaction with people. An AI result may be probabilistic or outside its trained operating domain. A disclaimer does not override an expressly guaranteed performance or excuse an undisclosed known danger.
8.3 The user may use its own results for the agreed development purpose, subject to rights in incorporated third-party content and any specific software license. Olive does not obtain ownership of user input or output merely by providing a tool. Raw measurements, protected compilations and model files may have different legal status.
8.4 Do not submit special-category personal data, export-controlled technical data or secrets beyond the service's permitted scope. If the task requires such processing, arrange an appropriate service configuration and written agreement before submission.
8.5 Generated trajectories, inferred poses, classifications, anomaly flags and suggested code must be independently evaluated before they influence physical action. Do not connect a demonstration output directly to live hazardous actuation. Test changes in an appropriately isolated or simulated environment first and preserve the safeguards required by section 3. Neither an attractive visualisation nor a technically successful test establishes fitness for an unagreed deployment.
9 APIs and remote connections
9.1 API access is limited to the authorised endpoint, purpose, credentials and published or agreed rate limits. A trial key does not authorise production operation or third-party resale. Customer applications must handle errors, authentication expiry, rate limits and changes using reasonable engineering practices.
9.2 Olive may introduce reasonable technical limits to protect availability and security. A material reduction of contracted capacity or removal of a paid API feature requires the applicable contractual change procedure and remedies. Breaking changes should be communicated with a reasonable migration period where practicable.
9.3 An API or browser control that can actuate hardware must be used only with the required local safeguards. Network access does not establish that a command is safe or that the remote user is authorised to command a particular robot. The operator must control authorisation, safe-state behaviour and emergency stopping within its responsibilities.
9.4 The operator is responsible for the local test release, access permissions and safe operating envelope within its control, including when Olive personnel provide authorised remote assistance. The assistance does not itself transfer site supervision to Olive. The actual agreed work and each person's own conduct remain subject to applicable responsibility. Necessary safety information must remain available even where a service is validly restricted.
10 Availability maintenance and third party resources
10.1 Olive may update or discontinue a gratuitous public information feature for legitimate operational reasons, subject to existing contractual and statutory duties. It will consider users' reliance and give reasonable notice where a withdrawal materially affects an established development workflow. Purchased documentation, mandatory safety information, security updates and source-code obligations are not made unavailable merely by this clause.
10.2 Unless separately agreed, the free website carries no service-level or continuous-availability commitment. Planned maintenance, urgent security work and external failures can affect access. Responsibility for Olive's culpable breach remains governed by section 14 rather than an unlimited availability disclaimer.
10.3 External links, embedded media, third-party code and platform services may be governed by additional terms. Olive does not control independent third-party pages simply by linking to them. Its own legal responsibility for linked or embedded content is assessed under applicable law and cannot be removed by a universal link disclaimer.
10.4 Optional third-party media or tracking must not load in a way that circumvents required consent. A user choosing to follow an ordinary external link interacts with the destination under its own notice; that fact does not authorise prior undisclosed tracking on Olive's page.
11 Security reporting
11.1 Send suspected vulnerabilities to contact@olive-robotics.com with the subject Security report. Include the affected URL, device or software release, a concise description, likely impact and minimal reproduction details. Ask for an appropriate secure exchange method before sending sensitive material. Do not place confidential customer data or private keys in the initial message.
11.2 Test only assets for which you have legal authorisation. Avoid accessing unrelated data, persistence, service disruption, social engineering and physical risk. Stop when necessary to prevent harm. Where confidential data is encountered incidentally, minimise access and disclose the issue privately through a lawful route.
11.3 Good-faith notification is welcome, but these terms do not create a bounty programme, blanket authorisation to test third-party systems or immunity from applicable law. A separate vulnerability policy may define a more specific authorisation. Nothing restricts legally protected reporting or statutory interoperability and research rights.
12 Content reports and restrictions
12.1 Report unlawful content, copyright concerns, privacy issues or impersonation to contact@olive-robotics.com. Identify the location, the nature of the issue and information sufficient for a meaningful assessment. Notices must be truthful. Personal data supplied in a report are handled under the Privacy Policy.
12.2 Olive may remove or restrict content or access on a substantiated basis where needed to address unlawful material, a material breach or a concrete security risk. Action must be proportionate and consider the user's legitimate interests, freedom of expression and applicable legal safeguards. Where appropriate and lawful, Olive will explain the action and provide a way to seek review.
12.3 If a specific Olive service qualifies as an intermediary or hosting service under the Digital Services Act, the service-specific obligations, notice mechanism, statements of reasons, points of contact and redress rights required for that service apply. These terms do not declare that every company website is an online platform or that any small-enterprise exemption removes all obligations.
12.4 A paid account will not be terminated merely because Olive prefers to discontinue a feature during an agreed term. The contract, applicable cure periods and statutory remedies govern. Access to personal data rights, legally required product information and a complaint route remains available independently of an account restriction.
13 Confidential resources
13.1 Access to a restricted repository, beta release or portal does not itself establish the content's safety or production suitability. Where a confidentiality obligation has been validly agreed, the user must restrict access to authorised persons and protect non-public designs, test results, prices, credentials and roadmaps with reasonable care.
13.2 Information already lawfully public, independently developed, lawfully obtained without restriction or disclosed under a legal duty is not made confidential by these terms. Legally protected whistleblowing, regulatory disclosures and the exercise of legal rights remain unaffected. Specific confidentiality agreements govern where applicable.
14 Liability
14.1 Olive remains liable without contractual limitation for intentional or grossly negligent conduct; culpable injury to life, body or health; fraudulent concealment; assumed guarantees to their agreed extent; mandatory product liability; and any other non-excludable liability. Nothing in these terms limits statutory personal data rights or remedies that cannot be contractually restricted.
14.2 Where these terms form a contract, for simple negligence Olive is liable for breach of an essential contractual obligation, limited to foreseeable loss typical for that contract. An essential obligation is one necessary for proper contractual performance on which the user may ordinarily rely. Liability for simple negligence in other cases is excluded only insofar as legally permissible. Section 14.1 always prevails.
14.3 Information is prepared with reasonable care but may become outdated. The user should use the version applicable to its device or release and report errors. This qualification does not negate a binding product description, a statutory information duty or liability for misleading statements. Purchase-related claims follow the purchase contract and mandatory law.
14.4 The permitted exclusions and limitations also benefit Olive's managing directors, employees, representatives and persons engaged to perform the relevant service. Where these terms form a contract, those persons may invoke that protection directly under § 328 BGB, subject to all exceptions in section 14.1. A person acting for Olive is not a personal guarantor or co-debtor merely because of that role. Independent mandatory personal liability remains unaffected.
14.5 A business user shall indemnify Olive against established third-party civil liabilities and reasonable necessary defence costs to the extent caused by that user's culpable breach of its contractual obligations, including unlawful content, unauthorised access or dangerous use prohibited by section 3. Olive shall notify the user promptly, mitigate loss and permit reasonable participation. A settlement imposing an obligation on the user requires consent, not unreasonably withheld for a reasonable settlement. Liability must be established by a final enforceable determination, an agreed settlement or other sufficient basis; an allegation alone does not establish an indemnity. Olive's own share of responsibility, non-transferable duties and non-reimbursable fines are excluded. Mandatory rights and section 14.1 prevail.
14.6 Subject to section 14.1, Olive is not responsible for loss to the extent attributable to a user's independent application, unsafe test arrangement, external components or activity for which Olive owes no relevant duty. Mixed causation, mitigation, unusually high loss and backup responsibilities are assessed under applicable law, including § 254 BGB. The user is not required to prove facts legally allocated to Olive. The permitted limitations cover contractual and non-contractual claims only where they may lawfully be agreed.
14.7 The framework of §§ 305 to 310 BGB, § 276(3) BGB and mandatory product-liability and data-protection law governs these provisions. Viewing a public page alone does not establish an agreed release of liability. Nothing removes the right to bring a lawful claim or make a protected regulatory report.
15 Changes and ending use
15.1 Olive may change informational website content prospectively. Material changes to an ongoing contractual service or accepted terms require a legally valid agreement or a separately valid, transparent change mechanism. A new version displayed on a page does not, without more, change past orders or an existing paid license.
15.2 Users may stop using the public website at any time. Closing an account does not automatically terminate a paid subscription; follow the agreed cancellation process. Olive will not make cancellation, data-access requests or exercise of statutory rights unreasonably difficult.
15.3 On ending an account, export, return and deletion of data follow the applicable service agreement and mandatory law. Rights in a lawfully obtained perpetual software copy and applicable open-source rights are not cancelled merely because a website account closes.
15.4 A substantiated material safety breach may justify restriction of the affected online function or account, with notice and a reasonable opportunity to remedy where appropriate. An urgent risk may justify immediate proportionate action where legally permitted. Olive shall explain the grounds as soon as reasonably practicable and lawful. Restriction must not itself create a physical hazard or obstruct mandatory rights, safety notices or legally required reporting.
16 Governing law and legal remedies
16.1 A contract under these terms is governed by German law, excluding the CISG where relevant. For consumers, this choice does not deprive them of mandatory protection afforded by the law of their habitual residence where that protection applies. Mandatory local and international jurisdiction rules remain in force.
16.2 Munich courts are the agreed exclusive forum only for persons and circumstances in which a valid advance jurisdiction agreement is permitted, including qualifying merchants and public-law entities, and subject to applicable international requirements. Consumers and other persons retain their statutory courts. These terms do not impose an arbitration clause, class-action waiver or waiver of regulatory complaints.
16.3 An invalid provision is replaced by applicable statutory law under § 306 BGB where relevant; it is not automatically narrowed to the most restrictive lawful version. Individual agreements take priority. Contractual text-form clauses do not override mandatory form requirements or the legal effect of individual agreements.
17 Provider information and editorial responsibility
17.1 Provider information is given above and must also remain readily accessible in the website's separate imprint under § 5 DDG. Where journalistically and editorially designed content requires a responsible person under § 18(2) Medienstaatsvertrag, that person is Dr.-Ing. Mojtaba Karimi at Olive Robotics GmbH, Daimlerstraße 7, 85521 Ottobrunn, Germany.
17.2 Questions, notices, accessibility concerns and requests for permission may be addressed to contact@olive-robotics.com. Reporting an issue does not require accepting additional marketing or analytics. This document does not replace any service-specific accessibility statement, statutory consumer-dispute notice or other disclosure required for the service actually offered.
